Se comparan los comentarios realizados por Cayetano a la noción de justicia expuesta por Santo Tomás en S. Th. II-II, qq. 57-62. A partir de las notas recabadas, se ofrece una síntesis de la definición brindada por el Cardenal. Acudiendo a la noción de «tripartición» explicamos las fundamentales diferencias que encontramos entre los comentarios de Tomás de Vio y la doctrina de Tomás de Aquino. Finalmente, nos explayamos en algunas consideraciones con respecto a los alcances prácticos que tal noción implica (...) para la reflexión Ética. Il presente contributo indaga la trasformazione della definizione di “giustizia” da Tommaso d’Aquino (analogica) a Tommaso De Vio (univoca). Esaminando la connessione fra logica e filosofia morale si considera il tema della virtù e l‘interpretazione del pensiero dell’Angelico da parte del Gaetano. Si intende approfondire il rapporto fra la giustizia e il bene comune attraverso l’uso dell’analogia (Tommaso) o in altri termini (Gaetano). Il lavoro fa riferimento anche alla tesi di S. Hofstadter, secondo cui l’analogia è quasi un a priori (...) cognitivo con cui l’uomo concettualizza il mondo e progredisce nella conoscenza, tenendo presente il ruolo fondamentale che l’analogia svolge nella filosofia e nella teologia del Gaetano. Partendo dal presupposto che la nozione analogica di giustizia esprima più chiaramente il pensiero dell’Angelico sul rapporto con il bene comune, si osserva che il Gaetano fa uso di uno strumento diverso, interpretando la stessa virtù secondo una concettualizzazione di carattere univoco. E ciò, precisamente, per il suo modo di concepire l’analogia. Appaiono, quindi, due nozioni di giustizia in relazione al bene comune e a tutte le altre virtù morali. Come influisce tutto ciò sul discorso etico e sulla riflessione politica? Qual è il rapporto con la suprema potestas, il governo ecc.? Emergono chiaramente due diversi modi di argomentare e di rappresentare il mondo e le sue relazioni, cioè di costruire percorsi diversi sulla base dello stesso oggetto di studio. This paper investigates the definition of “justice” and its transformation, from Aquinas (analogical) to Cajetan (univocal). Through the commentaries of Cajetan to the S. Th., this contribution also deeps into the connection between Logic and Moral Philosophy. We intend to deepen the relationship between justice and the common good using the analogy (Aquinas) or not (Cajetan). This work also refers to the thesis of S. Hofstadter according to which the analogy is almost a cognitive a priori with which man conceptualizes the world and progresses in knowledge, bearing in mind the role that analogy played in Cajetan’s thought. If the analogical notion of justice renders much better the teaching of Aquinas, it is observed that Cajetan interpretates the same virtue according to univocity, because of his previous conception of the analogy. Therefore, we have two notions of “justice” related to the common good and the rest of the moral virtues. How could this affect the Ethics and the political reflections? What is the relationship between the suprema potestas, the government, etc.? Again, we have now two different ways of arguing and representing the world and its relations. (shrink)

En el presente escrito se ofrece un compendio de notas críticas en torno a las dificultades con las que se topa actualmente un investigador de temas relacionados con la Edad Media, se exponen los argumentos más comunes y las respuestas que destacados medievalistas han ensayado. El cometido de este trabajo es, en primer lugar, poner de manifiesto el prejuicio que persiste en torno al Medioevo. Luego, el de brindar un cuerpo bibliográfico que ayude a quienes deban justificar todavía hoy las (...) motivaciones de su elección. En tercer lugar, de constituirse en un instrumento de trabajo que vendrá enriquecido y actualizado sucesivamente, por nosotros mismos o por aquellos que se interesen en él. Finalmente, bajo el concepto de “_medioevofobia_”, hemos intentado asuntar las tristes experiencias tenidas y que asumimos continuaremos teniendo algún tiempo más. (shrink)

Resumen La argumentación es una forma de discurso en la que un hablante defiende una postura en una discusión. El presente trabajo se enfoca en la complejidad argumentativa y los recursos evaluativos y evidenciales que caracterizan las disputas de niños de diverso nivel socioeconómico. Se analizaron 94 disputas entre niños de 4 años y otros niños (5 a 10 años) en situaciones de juego espontáneo registradas en hogares de sectores socioeconómicos medio y bajo. El análisis identificó diferencias marginales en la (...) complejidad argumentativa entre los grupos. Por su parte se hallaron diferencias significativas en recursos de evaluativos de emocionalidad y en los evidenciales deónticos y exclamativos a favor de los sectores de nivel socioeconómico bajo. Los sectores medios registraron un mayor empleo de expresiones de causalidad y conectores. Los resultados se discuten a la luz de los hallazgos de investigaciones previas. Abstract Argumentation is a type of discourse in which a speaker defends a claim in a discussion. The present work focuses on the argumentative complexity and the evaluative and evidential resources that characterize the disputes of children of different socioeconomic levels. We analyzed 94 disputes between 4-year-old children and other children (5 to 10 years old) in situations of spontaneous play registered in homes of middle and low socioeconomic status (SES). The analysis identified marginal differences in argumentative complexity between the groups. On the other hand, significant differences were found in evaluative expressions of emotion and in deontic and exclamatory evidential markers, more frequently used by the low SES group. The mid SES group tends to use a higher number of expressions of causality and connectors. The results are discussed with reference to the findings of previous research. (shrink)

Reporting and investigating research misconduct can lead to disciplinary proceedings being initiated, and ultimately to disciplinary sanctions being imposed on convicted scientists. The conversion of research misconduct findings into disciplinary sanctions is poorly understood. This article analyses all the disciplinary decisions handed down on appeal by the Conseil national de l'enseignement supérieur et de la recherche (CNESER) between 1991 and 2023, concerning breaches of research integrity by academics and doctoral students ( n = 333). Three findings are highlighted. Firstly, the (...) article describes how the CNESER sanctioned research misconduct even before the notion of research integrity became part of French law, by monitoring scientists’ compliance with “deontological rules”. Secondly, we show that assessing disciplinary fault involves evaluating a much broader set of circumstances than the mere existence of research misconduct, which can explain why the latter do not result in disciplinary sanctions or lighter sanctions. Thirdly, the research highlights situations where research misconduct is intertwined with other allegations, blurring the relative importance of these motives in the awarding of disciplinary sanctions. The article concludes with a call for greater accessibility to the disciplinary decisions handed down by universities in the first instance, as a key next step in gaining a better understanding of the disciplinary response to research misconduct. This paper offers a framework for consciousness of internal reality. Recent PET experiments are reviewed, showing partial overlap of cortical activation during self-produced actions and actions observed from other people. This overlap suggests that representations for actions may be shared by several individuals, a situation which creates a potential problem for correctly attributing an action to its agent. The neural conditions for correct agency judgments are thus assigned a key role in self/other distinction and self-consciousness. A series of behavioral experiments (...) that demonstrate, in normal subjects, the poor monitoring of action-related signals and the difficulty in recognizing self-produced actions are described. In patients presenting delusions, this difficulty dramatically increases and actions become systematically misattributed. These results point to schizophrenia and related disorders as a paradigmatic alteration of a ''Who?'' system for self-consciousness. (shrink)

Résumé Les interstices représentent ce qui résiste encore dans les métropoles, ce qui résiste aux emprises réglementaires et à l’homogénéisation. Ils constituent en quelque sorte la réserve de « disponibilité » de la ville. Du fait de leur statut provisoire et incertain, les interstices laissent deviner ou entrevoir un autre processus de fabrication de la ville, ouvert et collaboratif, réactif et transversal. Ils nous rappellent que la société ne coïncide jamais parfaitement avec elle-même et que son développement laisse en arrière (...) plan nombre d’hypothèses non encore investies. L’interstice constitue certainement un des espaces privilégiés où des questions refoulées continuent à se faire entendre, où certaines hypothèses récusées par le modèle dominant affirment leur actualité, où nombre de devenirs minoritaires entravés, bloqués, prouvent leur vitalité. À ce titre, l’expérience interstitielle représente la parfaite métaphore de ce que peut être le mouvement de l’antagonisme et de la contradiction dans la ville postfordiste : un mouvement qui s’affirme au fur et à mesure de ce qu’il expérimente, qui monte en intensité grâce aux modalités de vie et de désir qu’il libère, qui s’oppose à la hauteur de ce qu’il est susceptible d’inventer et de créer. El trabajo tiene como objetivo analizar la incompatibilidad teórica existente entre el concepto (y/o los principios) del desarrollo sostenible y la producción de biocombustibles fundamentada en el modelo del agronegocio o agribusiness. Así en el primer ítem describimos los principales alertas emitidos a través de los Informes del IPCC (Intergovernmental Panel on Climate Change, o Panel Inter gubernamental sobre los Cambios Climáticos) destacando: a) la influencia y el papel de las actividades humanas en el proceso del calentamiento global y la (...) contaminación ambiental, y b) el costo de oportunidad de reducir las emisiones de CO2. En el segundo destacamos los principales inversionistas extranjeros interesados en la producción de los biocombustibles, colocando algunas reflexiones en relación a este negocio “lucrativamente sostenible”, y por último -a modo de consideración- enfatizamos la imposibilidad en relación a la creencia absoluta en el libre mercado como la mejor fuente de innovación y aprendizaje para desarrollar alternativas energéticas viables y sostenibles ambientalmente. El presente trabajo, estudia de forma sintética, la metodología y criterios utilizados en los países capitalistas (en este caso el Análisis Beneficio Costo) y socialistas en la cuantificación del excedente generado por las actividades de I+D, en el sector agropecuario como parte del desarrollo sostenible, o sea, la cuestión que se propone analizar es ¿será posible cuantificar el capital ambiental que tiende a ser escaso? ¿Cómo o con que precios evaluar las externalidades? ¿Será que la ciencia económica (en este caso (...) a través de la evaluación de proyectos agropecuarios) tiene alguna respuesta convincente de cómo asignar recursos no renovables? Este artículo busca describir y analizar de manera general los diferentes mecanismos y elementos de la política pública que facilitan el movimiento y/o la expansión de los agricultores de la soja, en el Estado de Mato Grosso y específicamente en la municipalidad de Sorriso, y las principales consecuencias económicas, sociales y ambientales. El trabajo está estructurado en cuatro partes. La primera caracteriza y describe los principales mecanismos con que la política pública favorece la expansión y/o ocupación de la soja en (...) el Estado de Mato Grosso. La segunda muestra las principales consecuencias sociales y medioambientales que acompañan al modelo de producción. La tercera plantea la necesidad de “políticas públicas de promoción” y modelos organizacionales como arreglos, innovaciones y sistemas productivos, que consideren las condiciones económicas locales. Artificial intelligence and robots may progressively take a more and more prominent place in our daily environment. Interestingly, in the study of how humans perceive these artificial entities, science has mainly taken an anthropocentric perspective (i.e., how distant from humans are these agents). Considering people’s fears and expectations from robots and artificial intelligence, they tend to be simultaneously afraid and allured to them, much as they would be to the conceptualisations related to the divine entities (e.g., gods). In two experiments, (...) we investigated the proximity of representation between artificial entities (i.e., artificial intelligence and robots), divine entities and natural entities (i.e., humans and other animals) at both an explicit (Study 1) and an implicit level (Study 2). In the first study, participants evaluated these entities explicitly on positive and negative attitudes. Hierarchical clustering analysis showed that participants’ representation of artificial intelligence, robots and divine entities were similar, while the representation of humans tended to be associated with that of animals. In the second study, participants carried out a word/non-word decision task including religious semantic-related words and neutral words after the presentation of a masked prime referring to divine entities, artificial entities and natural entities (or a control prime). Results showed that after divine and artificial entity primes, participants were faster to identify religious words as words compared to neutral words arguing for a semantic activation. We conclude that people make sense of the new entities by relying on already familiar entities and in the case of artificial intelligence and robots, people appear to draw parallels to divine entities. This article is the introduction to the special issue ‘Sociology and psychology: what intersections?’ In addition to presenting the articles included in this issue, the present text outlines the general stakes of interdisciplinarity between psychology and sociology. It argues that interdisciplinarity requires a specific conversion work between disciplines and that, in the particular case of sociology and psychology, importations and exportations of concepts and ideas have existed since the beginning of these disciplines.

In the literature on medical ethics, it is generally admitted that vulnerable persons or groups deserve special attention, care or protection. One can define vulnerable persons as those having a greater likelihood of being wronged – that is, of being denied adequate satisfaction of certain legitimate claims. The conjunction of these two points entails what we call the Special Protection Thesis. It asserts that persons with a greater likelihood of being denied adequate satisfaction of their legitimate claims deserve special attention, (...) care or protection. Such a thesis remains vague, however, as long as we do not know what legitimate claims are. This article aims at dispelling this vagueness by exploring what claims we have in relation to health care – thus fleshing out a claim-based conception of vulnerability. We argue that the Special Protection Thesis must be enriched as follows: If individual or group X has a greater likelihood of being denied adequate satisfaction of some of their legitimate claims to physical integrity, autonomy, freedom, social provision, impartial quality of government, social bases of self-respect or communal belonging, then X deserves special attention, care or protection. With this improved understanding of vulnerability, vulnerability talk in healthcare ethics can escape vagueness and serve as an adequate basis for practice. (shrink)

Metaphor abounds in both sign and spoken languages. However, in sign languages, languages in the visual-manual modality, metaphors work a bit differently than they do in spoken languages. In this paper we explore some of the ways in which metaphors in sign languages differ from metaphors in spoken languages. We address three differences: (a) Some metaphors are very common in spoken languages yet are infelicitous in sign languages; (b) Body-part terms are possible in very specific types of metaphors in sign (...) languages, but are not so restricted in spoken languages; (c) Similes in some sign languages are dispreferred in predicative positions in which metaphors are fine, in contrast to spoken languages where both can appear in these environments. We argue that these differences can be explained by two seemingly unrelated principles: the Double Mapping Constraint (Meir 2010), which accounts for the interaction between metaphor and iconicity in languages, and Croft's (2003) constraint regarding the autonomy and dependency of elements in metaphorical constructions. We further argue that the study of metaphor in the signed modality offers novel insights concerning the nature of metaphor in general, and the role of figurative speech in language. (shrink)

The belief that the spirits of the dead can return to haunt the living exists either as a tenet or as a marginal conviction in all civilizations, whether ancient or modern. More often than not, the dead do not return to reunite the living with their loved ones but rather to lead them into some dreadful snare, entrapping them with disastrous consequences. To be sure, all the departed may return, but some are predestined to haunt: the dead who have been (...) shamed during their lifetime or those who took unspeakable secrets to the grave. From the brucolacs, the errant sprits of outcasts in ancient Greece, to the ghost of Hamlet’s vengeful father, and on down to the rapping spirits of modern times, the theme of the dead—who, having suffered repression by their family or society, cannot enjoy, even in death, a state of authenticity—appears to be omnipresent on the fringes of religions and, failing that, in rational systems. It is a fact that the “phantom,” whatever its form, is nothing but an invention of the living. Yes, an invention in the sense that the phantom is meant to objectify, even if under the guise of individual or collective hallucinations, the gap that the concealment of some part of a loved one’s life produced in us. The phantom is, therefore, also a metapsychological fact. Consequently, what haunts are not the dead, but the gaps left within us by the secrets of others.Because the phantom is not related to the loss of a loved one, it cannot be considered the effect of unsuccessful mourning, as is the case of melancholics or of all those who carry a tomb within themselves. It is the children’s or descendants’ lot to objectify these buried tombs through diverse species of ghosts. What comes back to haunt are the tombs of others. The phantoms of folklore merely objectify a metaphor active within the unconscious: the burial of an unspeakable fact within the loved one.Here we are in the midst of clinical psychoanalysis and still shrouded in obscurity, an obscurity, however, that the nocturnal being of phantoms can, paradoxically, be called upon to clarify. The most recently published book of essays by Nicolas Abraham is Rythmes de l’oeuvre, de la traduction et de la psychanalyse . “Notes on the Phantom” is the preliminary statement of his theory of transgenerational haunting. In this paper we claim that pragmatist philosophical practice is incompatible with scientistic philosophy. The kind of pragmatism used for making this case follows the spirit and method of philosophical pragmatists such as William James, John Dewey, Richard Rorty, and a related pragmatic tradition, Confucian Philosophy. Pragmatism starts from immediate experience, and refuses to cleave off the reality and salience of what is found in such experience in the process of thinking. Pragmatism also concerns itself with social problems, broadly conceived. (...) In contrast to this focus on immediate experience, the influence of science in much philosophizing involves a kind of scientism through which the relevance, value, and even reality of experience is brought into question. It also concerns itself with a narrowly defined set of so-called philosophical problems. In this regard, pragmatist philosophical practice is fundamentally opposed to scientistic philosophical practice. We will start by modelling the kind of philosophical practice that stems from pragmatism, and the role of immediate experience in it. Subsequently, we will introduce two modes of philosophizing that diminish if not negate the role of experience. One is bald naturalist philosophizing, and the other is a priori scientific philosophizing. In the last section, we will show how main commitments of both of these traditions are incompatible with a pragmatist philosophy that remains committed to the original impulse of pragmatism. The distinction between analytic and synthetic propositions, and with that the distinction between a priori and a posteriori truth, is being abandoned in much of analytic philosophy and the philosophy of most of the sciences. These distinctions should also be abandoned in the philosophy of mathematics. In particular, we must recognize the strong empirical component in our mathematical knowledge. The traditional distinction between logic and mathematics, on the one hand, and the natural sciences, on the other, should be dropped. Abstract (...) mathematical objects, like transcendental numbers or Hilbert spaces, are theoretical entities on a par with electromagnetic fields or quarks. Mathematical theories are not primarily logical deductions from axioms obtained by reflection on concepts but, rather, are constructions chosen to solve some collection of problems while fitting smoothly into the other theoretical commitments of the mathematician who formulates them. In other words, a mathematical theory is a scientific theory like any other, no more certain but also no more devoid of content. (shrink)

A central problem for phronetic case-based approaches to the ethics of teaching lies in the proper determination of normative ethical problems. Judgments about the character of normative ethical problems depend in part on background beliefs about what is (or is not) of ethical value. Thus, to distinguish genuinely normative ethical problems, teachers seem to first require knowledge of what is of ethical value, which practical problems themselves cannot generate. To resolve this practical and theoretical problem, Nicolas Tanchuk and Alyssa Emery (...) argue for a Deweyan approach to teacher ethics that asserts two central theses: First, negatively, that inductive evidence warrants skepticism about any normative theory grounded in external reasons — (purported) reasons that are actually or possibly disconnected from an agent's motivational set of beliefs, desires, and dispositions. Second, that a cognitive and affective orientation toward solving problems through learning survives skepticism about external ethical reasons, grounding the commitments of many anti-oppressive teacher educators. According to both business enthusiasts and sober analysts like the U.S. Congressional Office of Technology Assessment, the new techniques of gene splicing would not only lift the drug industry out of its deep scientific and economic rut (characterized by long-declining introduction rates of genuinely novel medicines), but rejuvenate the American manufacturing sector (Chase 1979; Chemical Week 1987; (...) With his massive redeployment hypothesis (MRH), Anderson claims that novel cognitive functions are likely to rely on pre-existing circuits already possessing suitable resources. Here, we put forward recent findings from studies in numerical cognition in order to show that the role of sensorimotor experience in the ontogenetical development of a new function has been largely underestimated in Anderson's proposal.

The following paper argues that issues in paradigmatic proposals for solving the new demarcation problem stem from absolutist assumptions about judgments of value legitimacy. Both the problem of uninformativeness (Larroulet Philippi 2020; Fernandez-Pinto 2014, 2015) and the problem of ambiguous judgments of cases (Hicks 2014; Intemann 2017) are explained by an absolutist pretension contained in one of the main aims of these proposals: providing criteria for differentiating legitimate from illegitimate uses of values, without qualification. After presenting the problems and showing (...) how they stem from that common source, we will sketch a way forward, inspired mainly by Joseph Rouse’s Beyond Epistemic Sovereignty (1996), advancing routes that can allow philosophers of science to evade these pitfalls and engage with scientific practice in a more salutary manner. En el presente trabajo se ofrece, hasta donde nos consta, la única traducción al español del capítulo “Sobre el ajedrez” de la obra enciclopédica _De naturis rerum_ escrita hacia el año 1190 por el filósofo inglés Alejandro Neckam (1157-1217). El capítulo mencionado, que sigue a otro sobre los jugadores de dados, es relevante no solamente para comprender la continuidad de una actitud anti-lúdica que hunde sus raíces en el pensamiento de los primeros cristianos sino para advertir la recepción del ajedrez (...) musulmán en la Inglaterra medieval cristiana tanto en sus representaciones simbólicas como en las reglas del juego. This article describes a new type of medical-legal partnership (MLP) that targets the health and justice concerns of people enmeshed in the U.S criminal justice system: a partnership between clinicians who care for people with criminal system involvement and public defenders. This partnership offers an opportunity to not only improve patient health outcomes but also to facilitate less punitive court dispositions, such as jointly advocating for community-based rehabilitation and treatment rather than incarceration.

This article addresses the data protection and product safety regulatory models currently applied to consumer-facing health technologies. It explains how the design and structures of existing data protection and safety regulation in the U.S. have resulted in exceptionally thin protection for the users of consumer-facing devices and products that rely on or that facilitate consumer collection or aggregation of health and wellness data. It also examines some appealing legislative alternatives to the current thin model used in the U.S. and suggests (...) a framework for prioritizing ameliorative regulation. To better understand existing regulatory models, their deficiencies, and how they should be reformed, the article employs an analytical model describing these regulatory systems across two axes. The vertical axis describes the quantity or depth of regulation, such as, for example, the strictness of the rules imposed by the regulatory model. The horizontal axis describes the reach of the regulation, the behaviors, products, or industries to which the regulation applies. (shrink)
